On Thursday March 5, 2009 Leonardo Venture GmbH & Co. KGaA sent a
draft of a claim for damages to its former general partner - Leonardo
Venture Capital GmbH - and its former managing directors - Prof. Dr.
Köglmayr and Prof. Wupper-feld - as well as to the current managing
director Mr. Koop.
The claim for damages is the consequence of various breaches of duty
and mismanagement by the management of the general partner, which the
Supervisory Board of the limited part-nership uncovered in the course
of the past 2008 business year.
The draft of the claim for damages includes a time limit of ten days
during which the general partner and its management has been given a
final opportunity to reach an out-of-court set-tlement on the damages
suffered by the limited partnership. The letter includes an
an-nouncement that the lawsuit will be submitted after the expiry of
the above period of ten days. The claim is based on the joint and
several liability of Leonardo Venture Capital GmbH and its managing
directors; it comprises damages provisionally set at approximately 5
million euros.
