according to Section 21, Para. 1 WpHG that its voting rights in Software AG,
Uhlandstraße 12, 64297 Darmstadt, Germany, ISIN: DE0003304002, WKN: 330400,
exceeded the threshold of 3% of the voting rights on September 4, 2009, and on
that day amount to 3.01% (this corresponds to 863768 voting rights).
All voting rights in Software AG were attributed to FIL Holdings Limited
according to Section 22, Para. 1, Sent. 1, No. 6 WpHG in connection with Sent. 2
