The Regional Court of Freiburg (1st instance) has handed down
judgment in a legal dispute between Solar-Fabrik AG (ISIN:
DE0006614712) and a former member of its executive board (Vorstand),
awarding an amount of approximately EUR 1.6 million in damages to
Solar-Fabrik AG. These damages were incurred by Solar- Fabrik AG
consequent to the culpable breach of a duty by the former executive
board member. The duty consisted in the timely forwarding of certain
important information by the former executive board member to the
remaining members of the executive board of Solar-Fabrik AG, which he
failed to do. Solar-Fabrik AG consequently suffered damages, when it
granted a loan to a subsidiary in 2008, which it would not have
granted, had the said information been available to it at the time.
The loan had to be written off by Solar-Fabrik AG pursuant to the
ensuing insolvency of the subsidiary. The total amount that had to be
written off with regard to accounts receivables of Solar-Fabrik AG in
relation to its said subsidiary equated to approximately EUR 6.7
million. This was reported by way of an ad-hoc news on 12 March 2009.
To the extent that, and as soon as the judgment of the Regional Court
of Freiburg becomes final and binding, the damages awarded will be
entered into the books of account of Solar-Fabrik AG as a profit.
